These General Terms and Conditions of Sale apply to products sold on the website www.yade-paris.fr operated and managed by the company Yade. All orders on the Site are subject to these general terms and conditions of sale. These may be subject to modifications and updates; the conditions applicable to a Client's product order are those in effect on the day of the order.

All of this information is in French. The Client declares having full legal capacity to commit under these general terms and conditions. Thus, any order placed with Yade implies the Client's unconditional acceptance of these terms and conditions.

Consumers can review the general terms and conditions directly on the seller's website. The terms and conditions are binding if the consumer checks the designated box, acknowledging that they were known and accepted prior to placing the order. Confirmation of the order's validity by confirmation constitutes the buyer's agreement to the terms and conditions in effect on the day of the order.

The Seller reserves the right to modify its general terms and conditions at any time. In the event of modified terms and conditions, the applicable terms and conditions are those in effect on the date of the order, a dated copy of which may be provided to the consumer upon request.

Products are sold and delivered while stocks last. If the ordered product is out of stock, the seller will immediately inform the buyer and may provide a product of the same quality and price; otherwise, a voucher for the same amount as the order may be issued, which can be used for the next purchase. If the buyer does not agree, the seller will refund the amount paid within 14 days.

The online sales offers presented on this site are intended for consumers worldwide. The online sales offers available on the site are valid as long as the product appears on the site and while stocks last, without any specific duration indicated. The consumer's acceptance of the offer is confirmed by validating the order through the double-click process.
If you have benefited from an offer and wish to request a refund, it will be made proportionally to the amount of the order.

For each product listed on the site, the selling price is expressed in euros, including all French taxes (French VAT and any other applicable taxes), excluding shipping costs, order processing fees, and packaging fees. The total amount due from the customer is displayed on the order confirmation page. The selling price of the product is the price in effect on the date of the order. The selling price of the products does not include shipping costs, which are charged in addition to the price. In the case of promotional pricing, according to the terms of the promotional offers, the seller agrees to apply the promotional price to any order placed during the promotional announcement period.

The Seller reserves the right to change its prices at any time, while ensuring that the consumer is charged the price in effect on the day of the order.

Shipping costs, contribution to order processing fees, and packaging fees will be indicated in the Customer's cart before the final confirmation of the order.

To place an order, the consumer, after filling their virtual cart by selecting the product and desired quantity, then clicks the "Order" button and provides the delivery and payment details. Before clicking the "Confirm Order" button, the consumer can review the order details and total price, and can return to previous pages to correct any errors or modify the order if needed. Confirming the order constitutes acceptance of the Terms and Conditions and formation of the contract. The seller will send an email confirming receipt of the order and payment as soon as possible. Once the order is placed on our online store, your order is confirmed and sent to our warehouse. It is therefore no longer possible to modify or cancel it. You will receive an email as soon as it is shipped. The Seller reserves the right to refuse any order for legitimate reasons, especially if the quantity of products ordered is abnormally high for the buyer as a consumer, even if the order is already being processed. The sales contract is formed when the consumer sends an order confirmation.

Payment can be made immediately upon ordering. The site is equipped with an online payment security system that allows the consumer to encrypt the transmission of their banking data.

8.1. Immediate payment upon ordering
The price is due in full after order confirmation. Payment is made immediately upon ordering by credit card or via the Paypal system.

Yade delivers its products to all countries worldwide. The Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.). Products will be delivered to the address indicated by the customer on the order form. Please refer to the "Delivery" tab located at the bottom of the homepage for delivery times. If the product does not match the order, the consumer must file a complaint with the seller for a product replacement or possible cancellation of the sale. If the delivered product is not available, the seller may offer an equivalent product in quality and price or a voucher.

All products supplied by the Seller are subject to the legal warranty provided by Articles L221-1 and following of the Consumer Code and the warranty against hidden defects provided by Articles 1641 and following of the Civil Code. The consumer has two (2) years to assert either of these warranties. For non-conformity, the period starts from the delivery of the product. For hidden defects, the period starts from the discovery of the defect. If the apparent defect, non-conformity, or hidden defect of the item, as declared by the customer, is confirmed after an expert assessment, Yade commits to replacing the product or compensating the customer in the form of a voucher within fourteen (14) days. However, Yade cannot be held responsible for any misuse of the items by the customer.

Claims made under the warranties must be sent by email to contact@yade-paris.fr.

The Seller's liability cannot be engaged in the event of non-performance or improper performance of the contract, either due to the buyer's actions, an insurmountable and unforeseeable act of a third party to the contract, or force majeure.

13.1. Right of Withdrawal

Within 14 days from the receipt of their order, the Customer may request Yade to return the Product(s). The returned product(s) must be in new condition, not worn, tried on, or used in any way, and in their original packaging.

Non-returnable or Non-exchangeable Products
Promotional gift products cannot be returned or exchanged.

For returns from France:

• Credits are free of charge. The return label for exchanges is provided. However, delivery costs related to the new order remain the customer's responsibility.
• For refunds, an amount of €5.90 will be deducted from the total refunded amount.
• Only one exchange is possible per order. However, if the exchanged product is returned, it is only possible to request a refund.
  

For returns from Belgium:

• Credits are free of charge. The return label for exchanges is provided. However, delivery costs related to the new order remain the customer's responsibility.
• For refunds, an amount of €6.90 will be deducted from the total refunded amount.
• Only one exchange is possible per order. However, if the exchanged product is returned, it is only possible to request a refund.
  

For returns from any other country:

• Only refunds and credits are offered.
• Return shipping costs are the customer's responsibility, who may choose the carrier of their choice.
• The return request must be made via our return portal.
• Any customs fees related to the return are also the customer's responsibility.
• If customs fees are advanced by Yade, they will be automatically deducted from the refunded amount.

For any return, the risks involved are the customer's responsibility. It is therefore recommended to keep proof of deposit of the return.

Upon receipt, and subject to these return conditions, the seller will proceed with the exchange or refund of the order excluding initial shipping costs by crediting the customer's bank account within 14 days following receipt of the package by the seller. If these return conditions are not met, the amount necessary for reconditioning the item and putting it back on sale will be deducted from the refunded amount.


13.2. Returns

Any request for exchange or refund of items must be made via this portal.

Return Conditions

Items must be returned to us in their original condition, unworn and unwashed, in their intact original packaging, and with the product tag still attached. For the return of menstrual panties, the packaging must be intact, and the tab above the zip must not be torn. For the return of tights, the packaging must not have been opened. If an item is returned and does not meet these return conditions, the customer will be refunded with a deduction based on the anomaly found that allows reconditioning the product to its original state.

Products from the "Braderie" or "Archives" collection

Products from the "Braderie" or "Archives" collections cannot be exchanged. Only a refund or credit can be issued. Note that for credits, return shipping costs are free.

Returns must be made exclusively via our return platform.

For returns from France or Belgium:
→ A prepaid label will be provided, and its cost will be deducted from the refund. Return shipping costs are free in case of credit.

For returns from any other country:

→ The customer must provide their own return label.

If the customer wishes to change size, they must request a refund or credit and then place a new order for the desired product.
Refunds are processed within 14 business days from the date the return is processed by our warehouse. In case of any anomaly found on the returned product (worn, damaged, incomplete, stained, etc.), reconditioning fees may be deducted from the refunded amount.

Under no circumstances is the Client authorized to download or modify all or part of the Site, including its content (listed products, descriptions, images, videos, etc.). This Site or any part of this Site must not be reproduced, copied, sold, or exploited for commercial purposes without the express written permission of Yade. In general, all copyrights, trademarks, and other distinctive signs and property or intellectual property rights appearing on the Site shall remain the full and exclusive property of Yade. The Client is therefore required to respect intellectual property rights and may not use the trademarks appearing on the Site and on the Products, if applicable, or register a trademark that would harm the rights holder, except as otherwise provided by contract. The same applies to any other intellectual property rights.

Yade commits to using Clients' confidential information only within the scope of operating its Site and ensuring the proper processing of orders and customer service. For the proper processing of orders, the personal data collected will be subject to computerized processing, and the Client acknowledges being aware of this. Accordingly, the information concerning them may be shared with Yade's technical service providers.
Furthermore, Yade may use technical means to obtain non-personal information about internet users aimed at improving the site's functionalities, for example by tracking the number of visitors on certain pages. In accordance with the law of January 6, 1978, as amended by the law of August 6, 2004, the Client has the right to access and rectify personal data concerning them held in Yade's files. These General Terms and Conditions and accepted orders are subject to French law. The language of these General Terms and Conditions and accepted orders is French. In case of dispute, the French courts shall have exclusive jurisdiction.
